These Terms & Conditions (“Terms”) govern all purchases of fishing rods, related accessories (reels, line, rod cases, etc.), and custom rod - building services (collectively “Products/Services”) from WaveCrest Fishing (“Company,” “we,” or “us”). By placing an order via our website, retail store, or authorized dealers, you (“Customer,” “you”) agree to these Terms, our Privacy Policy, and any attached product specifications or service confirmations.
1. Order Acceptance & Modifications
- Your order constitutes a request to purchase Products/Services. We reserve the right to accept, reject, or adjust orders—e.g., due to stock shortages, discontinued models, or errors in pricing/description. A binding contract is formed only when we send a confirmation email (for online orders) or issue a signed receipt (for in - store/phone orders), detailing item(s), quantities, total cost, and delivery timelines.
- Post - confirmation modifications (e.g., changing rod length/action, swapping accessories, or updating shipping address) must be requested within 2 hours of order placement. We will confirm modification feasibility within 1 business hour; changes may delay delivery or incur additional costs (e.g., upgrading to a higher - tier rod model). Custom rod orders (with personalized grips, guides, or engravings) cannot be modified once production begins (typically 1 business day after order confirmation).
2. Product Specifications & Compliance
- All fishing rods and accessories meet industry standards (e.g., ISO 18785 for fishing tackle safety) and are labeled with key specs: rod length, power (light/medium/heavy), action (fast/medium/slow), line weight capacity, and lure weight range. We provide detailed product descriptions and images on our website; physical in - store products may vary slightly in appearance (e.g., wood grip grain) but not in performance.
- Due to supply chain updates, we may substitute out - of - stock accessories (e.g., rod cases, reel covers) with equivalents of equal or higher quality. We will notify you of substitutions via email before shipping; you may cancel the affected accessory portion of your order for a full refund if unsatisfied.
3. Delivery & Pickup
- Standard Delivery: We ship to U.S. addresses via USPS or UPS; delivery takes 3–7 business days for in - stock items, 10–14 business days for custom rods. Shipping costs are calculated at checkout (free for orders over $100). You must provide a valid delivery address; missed deliveries due to incorrect addresses or unavailability may result in redelivery fees ($10 per attempt).
- In - Store Pickup: For local customers, in - store pickup is free and available within 24 hours for in - stock items. We will notify you via text/email when your order is ready; unclaimed orders held for more than 14 days will be canceled, and a refund (minus a $5 restocking fee) will be issued.
- Damaged During Delivery: Inspect your order immediately upon receipt. If rods/accessories are damaged (e.g., broken rod blanks, cracked guides), notify us with photos of the damage and packaging within 48 hours of delivery. We will ship a replacement at no cost or issue a full refund, and arrange for return of the damaged item (we cover return shipping).
4. Payment Terms
- We accept major credit cards (Visa, Mastercard, American Express), PayPal, Apple Pay, and Google Pay. For in - store purchases, cash and debit cards are also accepted. Custom rod orders require a 50% non - refundable deposit at checkout; the remaining balance is due before shipping.
- All prices are listed in U.S. dollars and include applicable sales tax. Late payments (for custom orders with split payments) incur a 1% monthly fee on the unpaid balance; failure to pay the final balance within 7 days of production completion will result in order cancellation and forfeiture of the deposit.
5. Warranties
- Rod Warranty: In - stock rods include a 1 - year limited warranty against manufacturing defects (e.g., faulty guide attachment, blank cracking under normal use). Custom rods include a 1.5 - year warranty for the same coverage. This warranty does not cover damage from misuse (e.g., exceeding line weight limits, dropping rods on rocks), accidental breakage, or normal wear (e.g., worn grip foam, faded paint).
- Accessory Warranty: Reels, rod cases, and other accessories include a 6 - month warranty against defects.
- To claim warranty service, email us at support@wavecrestfishing.com with your order number, photos of the issue, and a description of use. We will review your claim within 3 business days and either repair the item, ship a replacement, or issue a pro - rated refund (based on the item’s age and condition).
6. Returns & Refunds
- In - Stock Items: Unused, unopened in - stock rods/accessories may be returned within 30 days of delivery/pickup for a full refund (minus shipping costs). Items must be in original packaging with tags intact; returned rods with signs of use (e.g., line on guides, grip wear) will be denied a refund or charged a 20% restocking fee.
- Custom Items: Custom rods are non - returnable (due to personalized design), except for manufacturing defects covered by warranty.
- Refund Processing: Refunds are issued within 5–7 business days of us receiving and inspecting the returned item, to the original payment method.
7. Limitation of Liability
- We are not liable for indirect damages, including lost fishing trips, missed catches, or third - party property damage, arising from delayed delivery, product defects, or improper use of Products. Our total liability for any claim shall not exceed the total amount paid for the affected Products/Services.
- We are not responsible for damage to rods/accessories caused by improper storage (e.g., leaving rods in extreme heat/cold) or failure to follow care instructions (e.g., not rinsing saltwater rods after use).
8. Governing Law & Disputes
- These Terms are governed by the laws of the State of Florida (where our headquarters is located). Disputes shall first be resolved through informal negotiation; if unresolved, disputes will proceed to binding arbitration in Miami - Dade County, Florida, per the rules of the American Arbitration Association, rather than litigation.
